Article 2. Scope
2.1 These general terms and conditions apply to any offer made by Kaas & Borrelz and to any agreement concluded between Kaas & Borrelz and the customer, regardless of whether the customer is a consumer or a business customer, unless expressly agreed otherwise in writing.
2.2 Before the agreement is concluded, the text of these general terms and conditions will be made available to the customer. If this is not reasonably possible, Kaas & Borrelz will inform the customer how the terms and conditions can be viewed and that they will be sent free of charge upon request.
2.3 Any agreements deviating from these terms and conditions are only valid if they have been expressly agreed in writing.
2.4 Any purchasing or other terms and conditions of the customer are expressly excluded, unless otherwise agreed in writing.
2.5 If any provision of these terms and conditions turns out to be void or is annulled, the remaining provisions shall remain in full force and effect. In that case, the parties shall consult each other to agree on a new provision to replace it, which approximates the purpose of the original provision as closely as possible.
Article 3. Offer and conclusion of the agreement
3.1 Every offer made by Kaas & Borrelz is non-binding and is valid only while stocks last, unless expressly stated otherwise.
3.2 Obvious misunderstandings or errors in the offer, for example regarding the price or description, do not bind Kaas & Borrelz.
3.3 The agreement is concluded when the customer accepts the offer via the website (places the order) and Kaas & Borrelz confirms this order by email.
3.4 Kaas & Borrelz reserves the right to refuse an order or attach further conditions to it, for example in case of doubt about the customer's creditworthiness, in the event of an unusually large order, or if products are not (anymore) available. The customer will be informed of this as soon as possible.
3.5 For business customers, an agreement may also be concluded by oral or written order confirmation.
3.6 Kaas & Borrelz is entitled at all times to cancel an order without stating a reason, provided it has not yet been dispatched or delivered to the customer. The customer will be informed of this as soon as possible. In that case, any amount already paid by the customer will be refunded as soon as possible, but no later than 14 days after the cancellation. The customer will not be entitled to any compensation (for damages) in that case.
3.7 Kaas & Borrelz also reserves the right to cancel an order if responsible delivery is not reasonably possible, for example due to extreme weather conditions or high temperatures that endanger the quality or shelf life of the products during transport. The customer will be informed of this as soon as possible and any amount already paid will be refunded as soon as possible, but no later than 14 days.
3.8 Photos and images on the website are indicative. The weight and appearance of products, including cheese and snack boards, may differ from the image or stated specifications due to their artisanal and fresh composition. For products that are cut by hand, the actual weight may differ by up to 10% from the stated weight. Such a deviation in weight, composition or appearance does not constitute a failure to perform the agreement.
Article 4. Prices
4.1 All stated prices are in euros and include VAT.
4.2 Shipping or delivery costs are not included in the product price and will be stated separately during the ordering process, before the agreement is concluded.
4.3 Kaas & Borrelz may change the prices on the website at any time. For an agreement already concluded, the price that applied at the time of ordering will remain valid.
4.4 Obvious errors or misunderstandings in a price statement may be corrected by Kaas & Borrelz even after the agreement has been concluded.
Article 5. Payment
5.1 Payment takes place in advance, when placing the order, via the payment methods offered on the website (such as iDEAL).
5.2 For business customers, payment in advance may be waived by mutual agreement and delivery may be made on account. In that case, a payment term of 14 days after the invoice date applies, unless otherwise agreed in writing.
5.3 If a business customer fails to pay on time, they will automatically be in default and statutory commercial interest will be due, as well as reasonable extrajudicial collection costs. For consumers, a reminder will first be sent with a payment term of 14 days, after which statutory (collection) rules will apply if payment is not received.
5.4 Kaas & Borrelz is entitled to suspend the execution of the order until full payment has been received.
Article 6. Delivery and shipping
6.1 Orders are shipped via a parcel service (such as PostNL, DHL, DPD or another courier service) to the delivery address provided by the customer.
6.2 Kaas & Borrelz strives to ship orders placed before the order deadline stated on the website on the next business day. The actual delivery time also depends on the chosen parcel service. The stated timeframes are indicative; exceeding them does not entitle the customer to compensation, unless expressly agreed otherwise.
6.3 Given the nature of the products (fresh and/or prepared chilled), it is important that someone is present at the delivery address to receive the order. Kaas & Borrelz is not liable for any loss of quality resulting from the failure to receive a delivered order in a timely manner.
6.4 Kaas & Borrelz is not obliged to ship the products chilled. The customer is aware that the products may not necessarily be kept chilled during transport. Kaas & Borrelz is not liable for any loss of quality resulting from the order being exposed to heat for an unnecessarily long period, for example if the customer does not receive the order in a timely manner.
6.5 The risk of the products passes to the customer as soon as the order has been delivered to the address provided by the customer.
6.6 In the event of damage during transport or incorrect delivery, the customer must report this in accordance with Article 8.
6.7 The customer is responsible for providing a correct and complete delivery address. Costs resulting from an incorrect delivery due to an address incorrectly provided by the customer will be borne by the customer.
6.8 Upon receipt, the customer must immediately store the products chilled (at 2 to 7°C, unless otherwise stated) and observe the expiration date and storage instructions stated on the packaging. Kaas & Borrelz is not liable for any loss of quality, spoilage or health complaints resulting from improper storage by the customer after delivery or from exceeding the expiration date.
Article 7. Right of withdrawal
7.1 The products of Kaas & Borrelz consist of (freshly prepared) cheese and snack boards and related products that spoil quickly or have a limited shelf life.
7.2 Pursuant to Article 6:230p, introductory part and under d sub 4 of the Dutch Civil Code, the statutory right of withdrawal therefore does not apply to these products. Consumers can therefore not withdraw from or return an order placed with Kaas & Borrelz, unless the delivered product does not conform to the agreement (see Article 8).
7.3 This exclusion does not affect the consumer's statutory rights in the event of a defective or damaged product.
Article 8. Inspection, complaints and warranty
8.1 The customer must inspect the delivered products immediately upon receipt for (transport) damage, correctness and completeness.
8.2 Complaints about the order, such as damage, incorrect delivery or quality defects, must be reported within 24 to 48 hours of delivery via info@kaasenborrelz.nl, accompanied by a clear description and, where possible, photos. Given the limited shelf life of the products, a complaint reported outside this timeframe may no longer be processed, unless this could not reasonably be expected of the customer.
8.3 Kaas & Borrelz will assess a complaint as soon as possible and no later than within 14 days. If the complaint is found to be justified, Kaas & Borrelz will, at its discretion, redeliver the product free of charge, issue a credit, or refund the purchase price.
8.4 This complaint procedure does not affect the consumer's statutory rights (including the conformity requirements of Article 7:17 et seq. of the Dutch Civil Code).
Article 9. Liability and allergens
9.1 Kaas & Borrelz takes the utmost care in assembling its products and stating allergen information. Allergen information is available upon request via info@kaasenborrelz.nl and is stated on the website where possible.
9.2 Because products are assembled by hand, allergens such as milk, nuts, gluten or other allergens may not be completely excluded due to, for example, cross-contamination. Kaas & Borrelz strongly advises customers with allergies or intolerances to contact the company before placing an order. Kaas & Borrelz is not liable for the consequences of the customer not (timely) consulting this information.
9.3 The range of Kaas & Borrelz may contain raw milk cheese. Where applicable, this is stated on the product. The use of raw milk dairy products may pose a health risk (including listeria) for pregnant women, young children, the elderly and immunocompromised individuals. Kaas & Borrelz strongly advises these groups to consult a doctor before ordering or consuming such products and is not liable for any health damage resulting from ignoring this warning.
9.4 To the extent permitted by law, the liability of Kaas & Borrelz for damage resulting from an attributable failure to perform the agreement is limited to compensation for direct damage and to a maximum of the invoice amount of the order concerned.
9.5 Kaas & Borrelz is not liable for indirect damage, including consequential damage, lost profits, missed savings or damage due to business interruption.
9.6 The limitations in this article do not apply if the damage is the result of intent or willful recklessness on the part of Kaas & Borrelz, and do not affect mandatory liability towards consumers (including for personal injury or product damage).
9.7 For business customers, the provisions of Article 13 also apply.
Article 10. Force majeure
10.1 Kaas & Borrelz is not obliged to perform any obligation towards the customer if it is prevented from doing so due to force majeure.
10.2 Force majeure includes, among other things, disruptions in parcel services or suppliers, raw material shortages, extreme weather conditions, strikes, power or internet outages and government measures.
10.3 If the force majeure situation lasts longer than 30 days, both parties have the right to terminate the agreement in writing without liability for damages. Any amounts already paid will be refunded in that case.
Article 11. Intellectual property
11.1 All intellectual property rights in the website, texts, photos, logos and other content of Kaas & Borrelz and Cheese @ Home are vested in Kaas & Borrelz / Cheese @ Home or its licensors.
11.2 The customer is not permitted to reproduce, publish or otherwise use this content without prior written permission, except for personal use within the scope of the agreement.
Article 12. Personal data
12.1 Kaas & Borrelz processes the customer's personal data in accordance with applicable privacy legislation (AVG/GDPR) and exclusively for processing the order, customer contact and, where applicable and with permission, marketing purposes.
12.2 More information about the processing of personal data can be found in the privacy statement on the Kaas & Borrelz website.
Article 13. Additional provisions for business customers (B2B)
13.1 This article applies exclusively to customers who are acting in the course of a profession or business.
13.2 Notwithstanding Article 7, the right of withdrawal does not apply to agreements with business customers.
13.3 Objections to invoices must be reported in writing within 8 days after the invoice date, failing which the invoice will be considered accepted.
13.4 Ownership of delivered products only passes at the time of full payment of the invoice concerned (retention of title).
13.5 Kaas & Borrelz is entitled to transfer these general terms and conditions and the agreement, in whole or in part, to third parties in the context of a business transfer, without the prior permission of the business customer.
Article 14. Complaints procedure and disputes
14.1 Complaints about the execution of the agreement must be submitted to Kaas & Borrelz as soon as possible, fully and clearly described, via info@kaasenborrelz.nl.
14.2 Kaas & Borrelz strives to respond substantively to a submitted complaint within 14 days.
14.3 If the parties cannot reach an agreement, the consumer may submit the dispute to the competent court or make use of the European ODR platform (ec.europa.eu/consumers/odr).
Article 15. Applicable law and competent court
15.1 Dutch law exclusively applies to all offers made by and agreements with Kaas & Borrelz.
15.2 Disputes between Kaas & Borrelz and the customer shall be submitted exclusively to the competent court of the Rechtbank Midden-Nederland, unless mandatory law prescribes otherwise. For consumers, it applies that they may choose, within one month after Kaas & Borrelz has invoked this clause in writing, to have the dispute settled by the legally competent court.
Article 16. Final provisions
16.1 Kaas & Borrelz reserves the right to change these general terms and conditions. The most current version can always be viewed on the website. For an agreement already concluded, the version that applied at the time of concluding that agreement remains valid.
16.2 These general terms and conditions were last amended on 13 August 2026.
